Internet access and valid email account necessary in order to experience the web-based portion of competition, although there is also an option to mail in your entry.

1. CONTEST PERIOD

The CATCH “Experience Seafood like Never Before” Contest (the “Contest”) is comprised of two elements: a daily contest and a grand prize draw.

The Daily Prize Contest (“Instant Win”) runs every day from May 28 to June 20, 2010. More specifically, it will run from 6 AM AST to 11 PM AST on May 28-June 19, and from 6 AM AST to 4PM AST on June 20.

The Grand Prize Draw (“Grand Prize”) will take place live at CATCH The Nova Scotia Seafood Festival at the Cunard Centre in Halifax, on June 20, 2010 at approximately 4:45 AST.

This Contest is brought to you by the Nova Scotia Department of Agriculture, Fisheries & Aquaculture. (the “Contest Sponsor”).

2. ELIGIBILITY

NO PURCHASE NECESSARY. The Contest is open to all legal residents of Canada, excluding the Province of Quebec, who have reached the age of majority in their home province at the time of Contest entry. All entries for the daily prize are automatically entered into the Grand Prize Draw.

Notwithstanding the above, this Contest is not open to employees of the Contest Sponsor, its respective divisions, subsidiaries, affiliates, advertising and promotional agencies, Contest suppliers and judges, members of their immediate families (parents, siblings, spouses) and those with whom they are domiciled.

3. HOW TO ENTER

There are 3 ways to enter the daily contest:

a) Online Webcam Option:

Entrants must go to either www.novascotiaseafoodfestival.com/contest or facebook.com/CATCHfestival during the Contest Period and follow the online instructions exactly as they appear. In order to complete their submission, entrants need a printed version of the CATCH Fish Icon. This Fish Icon appears on a CATCH print ad or postcard (which will appear in various publications across the province of Nova Scotia during the Contest Period), or they can print off the Fish Icon as it appears onscreen and follow instructions as outlined online.

b) Online Non-Webcam Option:

Entrants must go to either www.novascotiaseafoodfestival.com/contest or facebook.com/CATCHfestival during the Contest Period and follow the online instructions as they appear. If the entrant’s computer does not possess a webcam, the contest server will automatically recognize this, and they will be redirected to a video that will automatically tell the entrant whether they have won or lost.

c) Mail-in Option:

An entrant may hand print their name, address, email address, postal code and phone number on a plain 3” x 5” piece of paper and sign it. Place the entry form in an envelope and mail it with sufficient postage to:

Limit of one (1) entry per envelope with sufficient postage. All mail-in entries must be received by no later than June 18, 2010 at 5:00PM AST and will bear the same odds as those received online.

Upon receiving the mail-in entry, it will be entered electronically by proxy using the same set of instructions as outlined above.

Grand Prize Entry:

Whether an entrant wins or loses in the daily prize contest, they will be asked to submit a form to be entered for the Grand Prize Draw.

By entering this Contest, you agree to abide by and be bound by these Contest rules and the decisions of the Contest Sponsor with respect to all aspects of the Contest, which decisions are final.

4. PRIZES

Daily Contest Prize(s)

There are a total of twenty-four (24) daily prizes available to be won as further outlined below:

“Inspired By The Sea Gift Package” consisting of:

  • a pair of tickets to CATCH The Nova Scotia Seafood Festival on June 19 or 20, 2010;
  • a pass for 2 people to cruise on the Tall Ship Silva;
  • a Taste of Nova Scotia seafood themed gift basket.

Approximate value of each daily prize is $85.

Grand Prize

There is a total of one (1) Grand Prize to be won as further outlined below:

One (1) Grand Prize with an approximate value of $1,500 available to be won:

The “Ultimate Seafood Kitchen Party”, will be an exclusive, catered dinner for the winner and guest and 6 of their friends at the winner’s home. The evening will include a Nova Scotian seafood-themed menu prepared by a Taste of Nova Scotia chef, including fresh local food and wine pairings, and musical entertainment.

5. DRAW & METHOD OF AWARDING PRIZES

DAILY PRIZES (Instant Win)

One (1) entry will be randomly selected daily from all eligible entries received during the Instant Win Period. The entrant will be notified automatically if they have won or lost. In either case, the entrant’s name, phone number and email address will be requested in order to ensure the entrant will be entered into the Grand Prize Draw. The winning entrant will be asked to complete the contact information form within 15 minutes of receiving the winning notification. If the submitted information is not received in 15 minutes or less, the entry is discounted and another winner will be randomly selected. The Instant Win winner will also be contacted to coordinate collection of prize. Winner will also be asked to sign a release form allowing rights for the CATCH Festival organizers to use the winners’ names and likeness for promotional purposes. Names, phone numbers and email addresses of entrants will not be used for any other reason. If the selected winning entrant cannot be reached, for whatever reason, another entrant may be randomly selected from the remaining eligible entries or the prize may be cancelled at Contest Sponsor’s sole discretion.

Before being officially declared a winner of the Instant Win Prize, selected winning entrant must correctly answer, unaided, a time-limited, mathematical skill-testing question and complete, sign and return a Declaration and Release Form (and any other documents, as applicable) by the date indicated on the form (the “Prize Claim Date”). If a selected entrant cannot be reached within the Prize Claim Date specified above, is not in compliance with these Contest rules, incorrectly answers the skill-testing question, declines the prize, email correspondence between Contest Sponsor and selected entrant is returned as undeliverable without a forwarding address, or fails to return the Declaration and Release Form (and any other documents, as applicable) by the Prize Claim Date, the prize may not be awarded and Contest Sponsor reserves the right to randomly select another entry from the remaining eligible entries at Contest Sponsor’s sole discretion.

GRAND PRIZE:

On June 20, 2010, at approximately 4:45 PM AST, at the CATCH Festival in Halifax, NS, one (1) entry will be randomly selected and announced from all eligible entries received during the Contest Period at CATCH The Nova Scotia Seafood Festival by a representative of the Contest Sponsor. If the winner is not in attendance, we will attempt to contact the selected entrant, by email or phone, within fifteen (15) business days of the draw date, with further information on how to claim the Grand Prize. If the selected entrant cannot be reached, for whatever reason, another entrant may be randomly selected from the remaining eligible entries or the prize may be cancelled at Contest Sponsor’s sole discretion.

Before being declared the official winner of the Grand Prize, selected entrant must correctly answer, unaided, a time-limited, mathematical skill-testing question and complete, sign and return a Declaration and Release Form (and any other documents, as applicable) by the date indicated on the form (the “Prize Claim Date”). Grand Prize will be delivered at a time mutually convenient for all parties concerned within approximately 8 weeks from the date on which the winner is verified. The actual date of the Kitchen Party will depend upon the availability of the selected chef and musician(s).

GENERAL

6. All prizes must be accepted as offered and/or awarded and may not be transferred, exchanged or substituted, whether for cash or otherwise except as expressly provided in these Contest rules or at the Contest Sponsor’s sole discretion. The Contest Sponsor reserves the right to substitute a prize or portion thereof with one of at least equal value in the event of the unavailability, for whatever reason, of the advertised prizes. If, for any reason, more than the advertised number of prizes are claimed, there may be a random draw conducted amongst all eligible prize claimants, at Contest Sponsor’s sole discretion, to award the correct number of prizes after the Contest closing.

7. The decisions of Contest Sponsor are final and entrant agrees to abide by all of the instructions and decisions of the Contest Sponsor. In the event of any dispute regarding the interpretation of these Contest rules, the decision or interpretation of the Contest Sponsor shall prevail.

8. All entries become the property of the Contest Sponsor. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. Contest Sponsor is not responsible for lost, stolen, delayed, damaged or misdirected claims or entries or for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest Period. The Contest Sponsor is not responsible for any errors or omissions with respect to the printing or advertising of this Contest and reserves the right to withdraw, amend or cancel this Contest in the event of a printing or administrative error. If for any reason whatsoever Contest Sponsor determines in its sole discretion that this Contest is no longer capable of running as intended, Contest Sponsor may in its sole discretion withdraw, amend, cancel or modify this Contest in any way, in whole or in part.

9. The Contest Sponsor accepts no responsibility for loss, damage or claims caused by the awarded prizes or the Contest itself. By entering, entrant releases and holds harmless Contest Sponsor, its affiliated and related companies and advertising, promotional agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the “Contest Entities”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any prize won.

10. Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by users of the Contest Website or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in operation of the Contest Website or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants’ or to any other person’s computer related to or resulting from participating or downloading materials in this Contest. If the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever, the Contest Sponsor reserves the right at its sole discretion to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way.

11. In the event of a dispute as to who submitted an email entry, the entry will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Selected entrant may be required to provide the Contest Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.

12. The Contest Sponsor reserves the right at its sole discretion to disqualify, with or without notice, any individual from the Contest, and to ban that individual from participation in any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Contest or where applicable, the Contest Website; to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor’s agencies, other entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

14. By entering this Contest, entrants consent to the Contest Sponsor’s use, should they become a winner, of their name, Province of residence and any photograph or other likeness, without further compensation or notice, for publicity, advertising or informational purposes in any media or format (including the Internet) in connection with this Contest or future similar contests. By entering, entrants declare they have complied with the Contest rules.

15. The Contest Sponsor is collecting personal data about the entrants for the purpose of administering this Contest only. No further informational or marketing communications will be received by entrants. The Contest Sponsor respects the entrant’s rights to privacy of personal information. Please review our Privacy Policy at www.novascotiaseafoodfestival.com for details on the manner in which we collect, use, disclose, and otherwise manage your personal information.

16. This Contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Nova Scotia, including FOIPOP and PIPEDA, and the laws of Canada applicable therein.

17. Facebook is an international, California-based company. Any personal information placed on facebook will be subject to its rules and regulations, and the use of any information on it is outside the control of the Province of Nova Scotia.

18. The invalidity or unenforceability of any provision of these Contest rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

19. While the some of the ads will appear in French publications, the actual contest is available in the English language only.
